NAPKOR s.r.o. is referred to in these Terms as "NAPKOR", "we", "us" or "our".
The customer is referred to as "you" or "the customer".
These Terms apply primarily to purchases made by consumers through our online store.
2. Products
Our online store offers bicycles, bicycle components, accessories, clothing, protective equipment and other bicycle-related products.
We make reasonable efforts to ensure that product descriptions, specifications, photographs, colours, dimensions and other information displayed on our website are accurate.
Minor differences in colour or appearance may occur due to screen settings, lighting conditions or normal manufacturing variations.
The customer should carefully review the product description, specifications, size information, compatibility information and safety instructions before placing an order.
3. Prices
All product prices displayed on our website are the prices payable for the relevant products.
NAPKOR s.r.o. is not registered for VAT and does not separately charge VAT on its invoices.
Standard delivery is free for all orders.
If any additional mandatory charges apply to a particular order, they will be displayed to the customer before the order is placed.
We reserve the right to correct obvious typographical, technical or pricing errors.
If an obvious pricing error affects an order, we may cancel the affected order and will inform the customer as soon as reasonably possible. If payment has already been made, the amount paid for the cancelled order will be refunded.
4. Ordering and Contract Formation
By completing an order through our online store, the customer submits an offer to purchase the selected products.
After an order has been submitted, we will send an order confirmation to the email address provided by the customer.
The purchase contract is concluded when NAPKOR accepts the customer's order and confirms the order.
If we are unable to accept an order, for example because a product is unavailable or an obvious error has occurred, we will inform the customer and refund any payment already received for the affected order.
5. Payment
Available payment methods are displayed during checkout.
The customer must provide accurate billing, delivery and contact information.
An order will normally be processed after payment has been successfully authorised or received.
6. Shipping and Delivery
Delivery is free for all orders.
Orders are normally processed and dispatched within 3–5 business days after the order has been accepted and payment has been successfully received.
The 3–5 business day period refers to our normal processing and dispatch time and does not necessarily represent the carrier's delivery time.
Actual delivery time depends on the destination, carrier and circumstances outside our reasonable control.
Further information is available in our Shipping & Delivery policy.
7. Delivery Delays
We make reasonable efforts to dispatch orders within the stated timeframe.
Delivery may nevertheless be affected by circumstances outside our reasonable control, including carrier delays, severe weather, strikes, transport disruptions, customs procedures, public holidays, technical failures or other exceptional events.
Nothing in these Terms limits any mandatory consumer rights relating to delayed or non-delivered orders.
Where an order is not delivered within the applicable legal timeframe, the customer retains all rights provided by applicable consumer law.
8. Transfer of Risk
For consumer purchases, NAPKOR remains responsible for the goods until the goods are physically received by the customer or by a third party designated by the customer, unless the customer independently chooses a carrier that was not offered by NAPKOR.
9. Right of Withdrawal
Consumers purchasing products online generally have a statutory right to withdraw from the purchase contract within 14 days without giving a reason.
For goods, the withdrawal period normally begins on the day the customer or a third party designated by the customer receives the goods.
Full information about the right of withdrawal, returns and refunds is available in our Returns, Refunds & Legal Guarantee policy.
10. Legal Guarantee of Conformity
Consumers are protected by mandatory statutory rights relating to the conformity of goods.
For new goods, EU consumer law provides a minimum two-year legal guarantee of conformity, subject to applicable national law.
If a product is defective or does not conform to the contract, the customer may have rights to repair, replacement, a price reduction or termination of the contract and refund, depending on the circumstances and applicable law.
These statutory rights are separate from the 14-day right of withdrawal.
Nothing in these Terms limits or excludes mandatory consumer rights.
11. Complaints and Claims
If a customer believes that a product is defective, damaged, incorrect or does not conform to the contract, the customer should contact us:
Email: Napkor.sro@proton.me
Phone: +420 770 414 392
Please provide the order number and a description of the issue. Photographs or video may be useful when assessing a product-related complaint.
We will handle complaints in accordance with applicable Czech and European consumer legislation.
12. Bicycle Safety
Bicycles and bicycle equipment must be used only for their intended purpose.
Customers must follow all manufacturer's instructions, warnings, maintenance requirements and safety recommendations.
Where professional assembly, adjustment or inspection is required, we recommend using a qualified bicycle mechanic.
Before riding, the customer should ensure that the bicycle is correctly assembled, adjusted and safe to use.
The customer is responsible for complying with applicable road traffic and cycling regulations in the country where the product is used.
Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited.
13. Product Safety
NAPKOR takes product safety seriously.
Customers should read all safety warnings and instructions supplied with products before use.
If a product is subject to a safety recall or other important safety notice, NAPKOR may contact affected customers using the contact details associated with their order.
Customers should contact NAPKOR promptly if they identify a potential safety issue with a product.
14. Intellectual Property
All content on the website, including text, photographs, graphics, logos, designs, product descriptions and other materials, is protected by applicable intellectual property laws unless otherwise stated.
Content may not be copied, reproduced, distributed or commercially exploited without prior written permission, except where permitted by law.
15. Personal Data
Personal data is processed in accordance with our Privacy & Cookies Policy and applicable data protection legislation.
16. Liability
Nothing in these Terms excludes or limits liability or consumer rights that cannot legally be excluded or limited.
NAPKOR is not responsible for losses caused by events outside our reasonable control to the extent permitted by applicable law.
Nothing in these Terms affects mandatory statutory consumer protections.
17. Governing Law
These Terms are governed by the laws of the Czech Republic.
However, if the customer is a consumer residing in another EU Member State, mandatory consumer protection provisions of that customer's country of residence may also apply where required by applicable law.
Nothing in these Terms deprives a consumer of mandatory rights provided by applicable EU or national consumer legislation.
18. Alternative Dispute Resolution
If a consumer complaint cannot be resolved directly with NAPKOR, the consumer may have the right to seek alternative dispute resolution.
For consumers in the Czech Republic, the competent authority for consumer alternative dispute resolution is generally:
Czech Trade Inspection Authority (Česká obchodní inspekce – ČOI)
Štěpánská 44
110 00 Praha 1
Czech Republic
Website: https://www.coi.cz/
Consumers may also contact the European Consumer Centre or another competent consumer protection authority where applicable.
19. Changes to These Terms
We may update these Terms from time to time to reflect changes in our business, services or legal requirements.
The version applicable to an order is generally the version in force at the time the purchase contract is concluded, unless otherwise required by law.
